Privacy Policy

1. Preamble

1.1 For the purposes of this privacy policy (“Privacy Policy”), “KDAN” or “we” shall refer to KDAN Mobile Software Ltd., KDAN Mobile Software America Inc., KDAN Japan Ltd., KDAN Singapore Pte Ltd. or PDF Technologies Ltd. that has entered into the Privacy Policy with users(“you”, “Users”) located in the corresponding region (hereinafter referred to as ‘you’ or the ‘User’).

1.2 Scope

When Users purchase the ComPDF Services (referred to as the “Services”), or when you provide us with any personal information in connection with cooperation, negotiations, communications, or any other form of interaction with us, you agree that your Personal Data (as defined below) will be collected, processed, and used in accordance with this Privacy Policy.

1.3 Definition of Personal Data

Personal Data means any data that may be used to directly or indirectly identify a person, such as the name, user name, password, email address that you provide to us (collectively, “Personal Data”).

1.4 Applicable Law and Contracting Entity

When using our Services, you agree to collect, process, and use Personal Data in compliance with the applicable laws of your region of residence. We will, according to the country/region of each User, comply with the applicable laws and ensure alignment of this Privacy Policy with Users as follows:
(1) If Users are located in the Americas (including but not limited to the United States and its territories, Canada, Mexico, Brazil, Argentina, Peru, etc.), the contracting party to this Privacy Policy shall be KDAN Mobile Software America Inc. Both parties agree to comply with the applicable privacy laws of the State of California, USA (including but not limited to the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA)), in collecting, processing, and using Personal Data, to the exclusion of any conflicting laws.
(2) If Users are located in Japan (including Okinawa, Ishigaki Island, etc.), the contracting party to this Privacy Policy shall be KDAN Japan, Inc. Both parties agree to comply with the applicable privacy laws of Japan (including but not limited to the Act on the Protection of Personal Information (APPI)) in collecting, processing, and using Personal Data, to the exclusion of any conflicting laws.
(3) If Users are located in Southeast Asia (including but not limited to Singapore, Thailand, Vietnam, Malaysia, Indonesia, etc.), the contracting party to this Privacy Policy shall be KDAN Singapore Pte. Ltd. Both parties agree to comply with the applicable privacy laws of Singapore (including but not limited to the Personal Data Protection Act 2012 (PDPA)) in collecting, processing, and using Personal Data, to the exclusion of any conflicting laws.
(4) If Users are located in Taiwan (including Penghu, Kinmen, Matsu, etc.), the contracting party to this Privacy Policy shall be KDAN Mobile Software Ltd. Both parties agree to comply with the applicable privacy laws of Taiwan (including but not limited to the Personal Data Protection Act and its Enforcement Rules) in collecting, processing, and using Personal Data, to the exclusion of any conflicting laws.
(5) If Users are located in the People’s Republic of China, the contracting party to this Privacy Policy shall be PDF Technologies Ltd. Both parties agree to comply with the applicable privacy laws of the People’s Republic of China (including but not limited to the Personal Information Protection Law, the Data Security Law, and the Cybersecurity Law) in collecting, processing, and using Personal Data, to the exclusion of any conflicting laws.
(6) If Users are located in any region other than those listed above, the contracting party to this Privacy Policy shall be KDAN Mobile Software Ltd. Both parties agree to comply with the applicable privacy laws of Singapore (including but not limited to the Personal Data Protection Act 2012 (PDPA)) in collecting, processing, and using Personal Data, to the exclusion of any conflicting laws.
In addition, KDAN fully acknowledges its obligations under the General Data Protection Regulation (GDPR) and the UK General Data Protection Regulation (UK GDPR) with respect to your personal data; if KDAN, you, or your affiliates or organizations meet any of the following circumstances, each shall comply with the UK GDPR and the GDPR in collecting, processing, and using Personal Data in addition to complying with the applicable privacy laws of your country/region as described above:
(1)Where any form of establishment or business presence is maintained within the EU/EEA or UK;
(2)Where business activities involve offering or intending to offer goods or services to individuals located in the EU/EEA or UK; or
(3)Where business activities involve monitoring or profiling the behavior of individuals located in the EU/EEA or UK.

2. Data Collected

2.1 Personal Data You Directly Provide to Us

When you contact us by filling out forms, or by letter, phone, or email, you directly provide us with your Personal Data. This includes(but not limited to) the Personal Data you provide in the following situations:

(1) Registering to use our website, app, Services, products, or other tools;

(2) Signing up for a webinar, contacting a sales representative, or subscribing to our newsletter;

(3) Using the online customer service function on our website to contact us about product usage issues;

(4) Participating in blogs, forums, or social media features;

(5) Entering a contest, promotion, or survey;

(6) Reporting a website issue;

(7) Uploading files to our services, demo versions, or tools;

(8) Other personal information you voluntarily provided.

2.2 Personal Data We Automatically Collect

(1) IP Address and Clickstream Data Each time you visit our website or use our application, we may automatically collect the following information:

I. Technical Information: Including the Internet Protocol (IP) address used to connect your computer to the internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system, and platform.

II. Visit Information: Including the full Uniform Resource Locator (URL) clickstream, which is the path of visiting, browsing, and leaving our website (including the date and time); the products you viewed or searched for; page response times, download errors, duration of visits to certain pages, page interaction information (such as scrolling, clicks, and mouseovers), methods used to leave the page, and any phone number used to call our customer service.

III. Information on Interaction with Our App: Through third-party analytics tools, which track data on crashes, errors, general user interaction with the user interface (UI), and the types of features you may use.

V. Your Information Shared by Third Parties:

A. Information published by other users may contain your data.

B. Information you generate or share when using third-party partner services. When you use a third-party account to log in to our products or Services, we need to verify your identity or link your account information and, with your authorization, associate the relevant account with our products or Services.

Our website may use the Google Analytics platform, a third-party website analysis tool designed to help us better understand User needs and optimize this service and experience. The Google Analytics platform is contractually prohibited from selling any data collected on our behalf. (2) Digital Tags (including Cookies), Online Tracking Technology, and Online Interest-Based Advertising

Digital tags are created by a website visitor's internet browser to allow a website to reference certain information during the same or subsequent visits. Examples of digital tags are Cookies or HTML5 web storage. Among other uses, digital tags can enable a website to recognize previous visits each time a visitor returns and to track what information was viewed on the site.
We use both session-based and persistent digital tags on certain parts of our website. These digital tags are created when you visit our website. Session-based tags exist while you remain on our website, while persistent tags continue to exist after you leave our website.

2.3 Personal Data We Receive from Other Sources

If you use any other websites we operate or other online projects or Services we provide, we may receive Personal Data about you. We also work closely with third parties (such as business partners, technology and delivery Services, ad networks, analytics providers, and search information providers) and may receive Personal Data about you from them. We may combine this Personal Data with the Personal Data you provide to us and the Personal Data we collect about you to create a consolidated set of Personal Data.

3. Purpose and Use of Data

(1) Provision of Services:
We will use the collected data to provide our services, including but not limited to: detailed information recorded while you use our services, and contacting you through your contact information when you submit feedback or inquiries. We process such data to provide services in accordance with the contract between us and you.
(2) Personalized services:
We process the data collected to learn how our Users use our Services and resources, and to provide personalized services. We process this data for our legitimate interests of improving our Services, and your legitimate interest to receive a tailored service.
(3) Send newsletter or marketing information to subscribers:
If you subscribe to our newsletter, we may send you marketing communications about our products and services. For existing customers, we may rely on our legitimate interest to provide information about similar products or services you have previously purchased or used, provided that you may cancel the subscription to the newsletter and opt out of such communications at any time, and you may find details regarding how to cancel the subscription in the bottom of our emails.
For new Users or non-customers, we will only send marketing communications where we have obtained your explicit consent in advance. You may withdraw your consent at any time, and we will provide a simple and effective means to do so.
(4) Manage special activities on our websites:
When you participate in our competitions, prize draws, or similar promotional events, we may process your personal data for the following purposes:
I. To administer the event, verify eligibility, contact you regarding participation, and deliver prizes based on legitimate interest;
II. To publish your name or other personal details in winner announcements, and/or to share your personal data with third-party sponsors or partners for marketing or promotional purposes based on your explicit consent.

We may process information gathered from research and/or analysis. This is our legitimate interest to improve our service experience, and to enhance the safety and stability of our Services. It is also the Users' legitimate interest to receive a secure and improving Service.

4. User Rights

Through the “Contact us” page on our websites ( https://www.compdf.com/contact-sales ), you may make an inquiry of, review, request a copy of, supplement or correct, demand the cessation of the collection, processing or use of, restrict the use of, and request the deletion of your Personal Data. Where you have the right to data portability under Article 20 of the EU and UK GDPR, you may request that we send the information you have provided to us in a format that can be read by a computer, to another organization designated by you.
If you request KDAN to stop, or restrict, collecting, processing, using your Personal Data, or to delete your Personal Data, we may be unable to continue to provide the Services, or unable to provide a complete experience of the Services, pursuant to your request.

5. KDAN AI Services

(1) While using KDAN AI Services included in certain Services, you may provide the input to the KDAN AI Services and receive output from the KDAN AI Services corresponding to the input. Please note that you are fully responsible for the input and the usage of the output(the "Content"), including but not limited to ensuring that the Content does not violate any applicable laws, or ensuring that the Content and the usage of the KDAN AI Services will not infringe upon any third party rights.
(2) To ensure the normal operation of KDAN AI functions and improve the quality of KDAN AI Services, KDAN would temporarily store the input data provided by Users. We promise not to utilize Users' Personal Data for AI data training or any other commercial purposes.
Depending on User needs, KDAN AI may use the technology provided in part by OpenAI, LLC ("OpenAI"), Azure AI, Google DeepMind, Alibaba Group Holding Limited, DeepSeek AI Technology Co., Ltd. and Meta Platforms, Inc. and strictly adheres to their policies. You must not violate any OpenAI and Microsoft policies while using KDAN AI, including but not limited to their content policy, sharing and publication policy, and community guidelines.
(3) KDAN AI Services will strive to provide the best possible results; however, the output generated by AI technology may contain inaccuracies, harmful content, or biases. We cannot be held responsible for any content or errors resulting from the usage of KDAN AI Services.
(4) Please note that due to the evolving nature of AI technology, the availability, content, pricing, and other aspects of the features provided by KDAN AI services may change in future versions.

6. Safety Measures

(1) We will adopt appropriate protection, storage, and process mechanisms and safety measures to prevent your Personal Data from being stolen, altered, damaged, lost, or leaked.
(2) We endeavor to maintain a secure environment by implementing security measures and vulnerability management practices consistent with industry best practices.

7. Retention Period

7.1 You may modify or delete most of the Personal Data stored in your KDAN account, including but not limited to files you have uploaded to KDAN Cloud, as well as notes and documents you have created using KDAN products.
7.2 Account Data for Certain Products within the Services:
(1) For legitimate business purposes and/or legal requirements (e.g., tax and accounting reasons), we will retain your data for the periods prescribed by applicable laws in accordance with Section 1.4 of this Privacy Policy.
(2) Your account data (including your email address, name, and password) will be retained until you delete your account or your account otherwise becomes inactive for any reason.
(3) To delete or deactivate your KDAN account, you may contact our customer service team via https://www.compdf.com/contact-sales . Please note that once your account is deleted, you will no longer be able to use any KDAN products or Services with that account, nor will it be possible to restore the deleted account data.
You acknowledge that any documents or files you upload to the Services will be deleted within 24 hours from the time of the uploading, or otherwise deleted in accordance with the retention periods prescribed by applicable laws as set forth in Section 1.4 of this Privacy Policy.
With respect to your user information (including but not limited to the email address you used when registering for certain products within the Services), unless otherwise required to be deleted under applicable laws pursuant to Section 1.4 of this Privacy Policy, you acknowledge that such information will be retained in our Service cloud infrastructure. We will make reasonable efforts to process and use such information in accordance with this Privacy Policy to protect your privacy. 8. Information Sharing and Disclosure

8.1 Unless one of the following conditions is met, we will not disclose or share your personal data with any third party:
(1) We have obtained your prior consent
Within the scope of your consent, we may share your personal data with third parties.
(2) Cooperation with Judicial or Government Authorities for Investigations and Notification Mechanisms
When a judicial authority or a legally authorized investigative agency requests access to, inquires about, or demands the provision of your personal data through formal documentation, or when a government agency requests access to or inquiries about your personal data pursuant to legal provisions or its official duties, we will verify the legality of such requests first.

These statistical data, which have been aggregated or de-identified, do not constitute personal data and may include, but are not limited to, application names, installation/uninstallation timestamps, and location data (such as country), which cannot reasonably be used to identify an individual.
(5) Compliance with Terms of Service
To enforce applicable terms of service( https://www.compdf.com/terms-of-service ), including investigating potential misuse by users and addressing security or technical issues, we may share personal data with third parties.
(6) Transfer and Notification Mechanism
In the event of a merger, acquisition, or sale of assets, we will continue to take measures to protect the confidentiality of personal data and notify affected users before transferring any personal data to a new entity.
8.2 KDAN strives to follow the principles of minimal collection and necessary disclosure to avoid using your data beyond the scope of your consent or legal requirements.

9. Third-party Websites or Services

(1) Our websites, applications, and Services may contain links, services, and advertisements run by third parties. These third-party links, services, and advertisements are not run by KDAN, and this Privacy Policy does not apply to said links, services, and advertisements. KDAN takes no legal responsibility regarding how these third parties collect, process, and use users’ Personal Data. It is the user’s own responsibility to review the terms of service or privacy policy of these third parties before contacting, clicking, or using said links, services, and advertisements.
(2) Our websites, applications, and services may use Third-Party Cookies, including but not limited to:
These third parties may include external service providers such as social media platforms and website traffic analysis services, but they are neither operated nor managed by KDAN, and are not within the scope of this Privacy Policy. KDAN does not assume any legal responsibility for the collection, processing, and use of user personal data by these third-party providers. These Third-Party Cookies may be Analytical Cookies, Performance Cookies, or Targeting Cookies.
Before using the aforementioned cookies, Users must carefully read and accept the Cookie policies stipulated by the third parties.
(3) We utilize automated processes to provide emails and notifications to Users depending on events that occur when using our Services, as well as determining the User's access level and operating a Chatbot.
We employ a third-party to facilitate User payments. This incorporates automated decision making to block high-risk payments.

10. Data Transfers

Your Personal Data may be processed on servers located outside of the country where you live. Regardless of where your Personal Data is processed, we apply the same protections described in this Privacy Policy. We also comply with legal requirements relating to cross-border transfers of Personal Data.
If your Personal Data is transferred to a third country or organisation, we will ensure there is either an adequacy decision in place, or in the absence of an adequacy decision we will implement appropriate standard contractual clauses to ensure the security of your data.

(1) Due to rapid technological developments, KDAN may update this Privacy Policy from time to time, to reflect the legal, technical, and commercial changes in accordance with relevant regulations. You agree that it is your responsibility to review the latest Privacy Policy regularly, and your continued use of KDAN products or Services will be deemed that you agree to the updated Privacy Policy. Should you disagree with any updated Privacy Policy, please discontinue your use of KDAN products or Services.
(2) Whenever we update this Privacy Policy, we will publish the updated Privacy Policy on KDAN’s websites, and will notify you soon through the applications or emails.

12. Right to lodge a complaint

You have the right to lodge a complaint with the appropriate supervisory authority in your country. If you do have any concerns about how we have handled your data we would kindly ask that you contact us in the first instance, before you speak to the supervisory authority, so that we have an opportunity to put things right.
